ConCourt to rule on using corporal punishment at home

JOHANNESBURG – On Thursday the Constitutional Court will consider if parents can use corporal punishment at home.

South Gauteng High Court in 2017  struck down the common law defence of reasonable defence, the judgement was appealed.

According to the court founding in 2017,  the defence violates children’s rights.

The organisation that brought forward the case was the Centre for Child Law on behalf of the Children’s Institute, The Peace Centre, and Sonke Gender Justice.

Carol Bower from the Peace Centre said the people who defend corporal punishment are reminiscent of those of hitting women.
